WHO THIS POLICY APPLIES TO

This policy applies to personal information we collect about our customers and prospective customers (including their personnel), website visitors, suppliers, event attendees and job applicants, whether collected through our website, in the course of providing our services or otherwise.

This policy does not apply to personal information contained in our clients’ systems, environments or data that we access, migrate, process or manage on their behalf when providing our services (Client Data). See “Client Data we handle on behalf of our clients” below.

This policy is not a contract and does not form part of any agreement between you and us.

Where lawful and practicable, you may deal with us anonymously or using a pseudonym (for example, when making a general enquiry). However, we generally need your name and contact details to provide our services.

Our services are not directed to persons under 18 and we do not knowingly collect personal information from anyone under 18. If we become aware that a child under 18 has provided us with personal information, we will delete that information as quickly as possible. If you are the parent or guardian of a child and you believe they have provided us with personal information without your consent, then please contact us.

We may also use your personal information to send you direct marketing about our services, events and offers where you have consented to receive it, or where you would reasonably expect it (for example, as an existing customer) and the law permits it.

You can opt out of our marketing communications at any time by unsubscribing or emailing us. We will action your request within 5 business days.

We also use information in aggregated and de-identified forms to improve our services, including: administering our website, producing reports and analytics, identifying user demands and assisting in meeting customer needs generally.

If you subsequently remove this information, copies may remain viewable in cached and archived pages on other websites or if others have copied or saved the information.

AUTOMATED DECISIONS AND ARTIFICIAL INTELLIGENCE

We do not use computer programs to make decisions about you, or to substantially and directly assist in making decisions about you, that could reasonably be expected to significantly affect your rights or interests. If this changes, we will update this policy to describe the kinds of personal information used and the kinds of decisions involved.

We may use artificial intelligence tools to support our business operations. Where we do, we use enterprise tools that we have assessed for privacy and security. We do not enter personal information or Client Data into publicly available AI tools, and we do not use Client Data to train AI models unless the relevant client has agreed in writing.

CLIENT DATA WE HANDLE ON BEHALF OF OUR CLIENTS

When we provide cloud migration, modernisation, managed services or generative AI services, we may access, copy, transfer, store or otherwise process Client Data, which may include personal information (and in some cases sensitive information) about our clients’ customers, employees and other individuals.

We handle Client Data on behalf of the relevant client, in accordance with our agreement with that client and its reasonable instructions, and only for the purpose of providing our services. The client is responsible for ensuring it has the necessary rights, notices and consents for us to handle Client Data. We do not use Client Data for our own purposes, such as marketing or analytics.

We protect Client Data using the security measures set out in our agreement with the relevant client. [Unless otherwise agreed with the client, we store Client Data in Australian data centres.] At the end of an engagement, we delete or return Client Data (including temporary copies created during a migration) as agreed with the client, subject to any legal retention requirements.

If you are an individual whose personal information forms part of Client Data and you wish to access or correct it, or make a complaint, please contact the relevant organisation directly. If you contact us, we will refer your request to that organisation and assist it as required by our agreement.

STORAGE AND SECURITY OF YOUR INFORMATION

We take reasonable steps to protect the personal information we hold from misuse, interference and loss, and from unauthorised access, modification or disclosure. We hold personal information electronically, including with reputable third party cloud service providers. Our safeguards include access controls, multi-factor authentication, encryption and confidentiality obligations on our personnel. However, no method of transmission or storage is completely

secure and we cannot guarantee the security of information. Credit card information is processed by our third party payment provider, [name], is encrypted before transmission and is not stored by us on our servers.

To enable us to deliver our services, we may disclose personal information to, or store it with, service providers located outside Australia. These recipients are likely to be located in [the United States, Singapore, Ireland and the United Kingdom]. Where we disclose personal information overseas, we take reasonable steps to ensure the recipient handles it consistently with the APPs, such as through contractual obligations.

We retain your personal information for as long as needed to provide services to you and as otherwise necessary to comply with our legal obligations, resolve disputes and enforce our agreements. When we no longer need personal information for any lawful purpose, we take reasonable steps to destroy or de-identify it.

In the event of a data breach involving personal information we hold, we will assess and respond to it in accordance with the Notifiable Data Breaches scheme under the Privacy Act, including by notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) where required. Where a breach involves Client Data, we will notify the relevant client in accordance with our agreement with it.

COOKIES AND PIXELS

A cookie is a small file placed in your web browser that collects information about your web browsing behaviour. Use of cookies allows a website to tailor its configuration to your needs and preferences. Pixels are small pieces of code that collect similar information. Information collected by cookies and pixels (such as your IP address, device identifiers and browsing activity) may in some circumstances be personal information. Most web browsers automatically accept cookies but you can choose to reject cookies by changing your browser settings. This may, however, prevent you from taking full advantage of our website.

In addition, cookies and pixels may be used to serve relevant ads to website visitors through third party services such as Google Ads and Meta (Facebook) advertising. These ads may appear on this website or other websites you visit. These third parties may collect information about your use of our website and use it in accordance with their own privacy policies. You can manage how they use your information through your Google Ads Settings and Meta ad preferences, and opt out of Google Analytics using the Google Analytics opt-out browser add-on.

We may disclose personal information to third parties where reasonably necessary for the purposes described in this policy, including to:

To the extent that we do share your personal information with a service provider, we take reasonable steps to ensure it handles that information in accordance with applicable privacy

DISCLOSURE OF YOUR INFORMATION

We may from time to time need to disclose certain information, which may include your personal information, to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request. Also, we may use or disclose your personal information to protect the rights, property or safety of Pureplay, our customers or third parties.
